Terms of Use

1) Overview

Welcome to Profectus (“App”, “Service”). Profectus helps users plan and track goals (e.g., fitness, nutrition, finance, skills), schedule sessions, and receive reminders, with optional AI-assisted suggestions. By accessing or using the App, you agree to these Terms of Use (“Terms”). If you do not agree, do not use the App.

The App may suggest plans (e.g., workouts, nutrition) generated by AI or templates. These are for informational purposes only and are not medical, dietary, legal, or financial advice. Always consult a qualified professional before making decisions that may affect your health, safety, or finances. You use the App at your own risk.

5) User Content & License

You retain ownership of content you submit (e.g., goals, notes, chat messages). You grant Profectus a worldwide, non-exclusive, royalty-free license to host, process, and display such content solely to operate and improve the Service (including AI-assisted features).

6) AI Features

AI features may be powered by third parties (e.g., Google Vertex AI / “Gemini”). Outputs can be inaccurate or incomplete. You are responsible for reviewing and deciding how to use such outputs. We may apply safety filters and token limits to ensure responsible use.

7) Subscriptions & Fees

Some features may be offered under paid plans or usage limits. Prices, tiers, and quotas may change with notice as provided by law or the applicable app store rules. Taxes may apply.

Both the free tier and any premium subscription tiers include soft limits on the number of AI tokens we will process and the number of active goals you can maintain at once. We publish the current caps in the App (Settings → User Stats) and may adjust them from time to time (for example, to protect system reliability). When you reach a limit, certain actions—such as generating additional goals or requesting new AI plans—may pause until the next reset window or until you upgrade to a tier with higher quotas.

The App is designed for one Profectus account with an active subscription per device/store account. Using the same App Store or Play Store account across multiple Profectus users on the same device may trigger validation safeguards; subscriptions remain bound to the first Profectus user that successfully validated that purchase on the device.

The App may send push notifications or email reminders. You can control notifications in your device settings or within the App.

9) Third-Party Services

The Service may integrate with third parties (e.g., calendars, analytics, cloud providers). Your use of those services may be subject to their own terms and policies.

10) Termination

We may suspend or terminate access if you breach these Terms or if required by law. You may stop using the App at any time. Certain provisions survive termination (e.g., intellectual property, disclaimers, limitations of liability).

11) Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

12) Limitation of Liability

To the fullest extent permitted by law, Profectus and its affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or business, arising from or related to your use of the Service.

13) Indemnification

You agree to indemnify and hold harmless Profectus from any claims, liabilities, damages, losses, and expenses arising from your use of the Service or your violation of these Terms.

14) Changes to the Terms

We may update these Terms from time to time. We will indicate the “Last updated” date at the top. Your continued use after changes constitutes acceptance.

15) Governing Law

These Terms are governed by the laws of England and Wales, without regard to its conflict of law rules. Courts in London, UK shall have exclusive jurisdiction, unless local consumer law requires otherwise.

16) Apple EULA Addendum (iOS)

  1. Acknowledgement. This EULA is between LifeHackr LTD and the end-user only, not Apple. LifeHackr LTD, not Apple, is solely responsible for the Licensed Application and its content. This EULA does not conflict with the Apple Media Services Terms and Conditions.
  2. Scope of License. The license is limited, non-transferable, to use the Licensed Application on Apple-branded products that the end-user owns or controls, and as permitted by the Usage Rules in the Apple Media Services Terms and Conditions. The Licensed Application may be accessed by other accounts associated with the purchaser via Family Sharing or volume purchasing.
  3. Maintenance and Support. LifeHackr LTD is solely responsible for maintenance and support of the Licensed Application. Apple has no obligation to provide any maintenance or support services.
  4. Warranty. LifeHackr LTD is solely responsible for any product warranties, to the extent not effectively disclaimed. If the Licensed Application fails to conform to any applicable warranty, the end-user may notify Apple and Apple will refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation.
  5. Product Claims. LifeHackr LTD, not Apple, is responsible for addressing any claims relating to the Licensed Application, including product liability, legal or regulatory compliance, and consumer protection, privacy, or similar claims.
  6. Intellectual Property Rights. In the event of any third-party claim that the Licensed Application infringes intellectual property rights, LifeHackr LTD, not Apple, will be solely responsible for investigation, defense, settlement, and discharge.
  7. Legal Compliance. The end-user represents that they are not located in a U.S. embargoed country and are not listed on any U.S. Government restricted party list.

  9. Third-Party Terms. The end-user must comply with applicable third-party terms when using the Licensed Application.
  10. Third-Party Beneficiary. Apple and its subsidiaries are third-party beneficiaries of this EULA, and Apple has the right to enforce it against the end-user.

We use reasonable technical and organisational measures to protect data. No system is 100% secure; please use a strong password and keep your device secure.

13) Permissions, Notifications & Voice/AI

The App may request device permissions (e.g., notifications, microphone). Notifications are optional and can be controlled in your device settings. Microphone access is used solely for speech-to-text; audio is processed for transcription and is not stored for other purposes. AI suggestions may be generated via third-party providers (e.g., Google Vertex AI/Gemini) using the context you supply. You can revoke permissions at any time in your device settings; affected features will stop working.

14) Changes to this Policy

We may update this Privacy Policy. Changes take effect upon posting with the “Last updated” date above. Your continued use signifies acceptance.

You can request deletion of your account and associated data via WhatsApp at +44 7522 605942 or by emailing Lifehackr25@gmail.com. You can also access this from the app via Help & Support. We will delete or anonymise data unless we must retain it for legal reasons or to resolve disputes.
